WEBSITE TERMS AND CONDITIONS OF USE
The general terms and conditions governing the relationship between you (the website visitor and/or registered user) and Navigate World Whisky (Pty) Ltd (“NWW”), the website owner, are detailed below.   They cover any and all use of www.spiritssouthafrica.co.za (“the website”).   The terms and conditions may be updated and modified at any time; and will place a notice on the website informing you of such changes.   You agree to be legally bound by these terms and conditions by visiting and/or using the website and continued use of the website implies full understanding and acceptance of our terms and conditions.

Warranty by User / Sale of Alcohol
Navigate World Whisky sells liquor under a valid liquor licence.  In terms of South African liquor legislation it is an offence for any person under the age of 18 years to purchase, or attempt to purchase, liquor and/or to present false evidence of age in order to access and/or purchase liquor for or on behalf of any person under the age of 18 years.  By ordering, or attempting to order, any liquor products from Navigate World Whisky, you hereby warrant that you are of legal drinking age and agree to these Terms and Condition.  Navigate World Whisky may require verification of your age and you agree to provide truthful and accurate information and to comply with the applicable liquor legislation.

Conclusion of Sales, Item Availability and Pricing

• Any orders placed on the website may be accepted by NWW, or rejected.
• Conclusion of an agreement of sale will be concluded when your products have been delivered; regardless of any communication from NWW, the selected courier/delivery company or information on the website regarding the status of your order or payment.
• Should NWW reject your order after payment has been made, you will be notified immediately and, as soon as possible thereafter, NWW will refund any monies paid or be issued a voucher, as selected by you.
• Cancelations will need to be returned as outlined in our Returns Policy.
• Navigate does not accept liability for orders returned to us or destroyed by customs in the event that an import is disallowed, if local import costs are not paid or if delivery is refused.  If the goods are returned to us, we will refund the balance of your order after inspecting the goods and deducting all costs incurred.
• Goods on a Wishlist or in the shopping cart do not constitute an order and the goods are not reserved.
• NWW reserves the right to alter the price of these goods or to remove such items if stock is no longer available, without any prior notice.
• NWW cannot be held liable for any products no longer available or for any price changes when you complete/attempt to complete the purchase process at a later stage.
• You agree that all stock is limited and that prices are subject to change without notice.
• While NWW constantly monitors on hand quantity reflecting on the website, stock availability is not guaranteed. If you have paid for your order and a product is no longer available, NWW will communicate this to you and you will be entitled to a refund for the amount for that item.
• NWW will make every reasonable effort to ensure the accuracy of the information reflected on the website regarding product description, availability, pricing and delivery charges. However, NWW many not be held liable for any loss, claim or cost relating to transactions, for any errors or omissions of any nature.

Ballots

• Entrants must have an account with www. SpiritsSouthAfrica.co.za, with a valid delivery address and they must use this email address to enter the Ballot.
• Only one Ballot entry per person, per household.  NWW reserves the right to exclude any entries where this condition has been breached.
• Winners are selected at random and all decisions are final.
• The Ballot is for one unit of the product and Entrants confirm that, if select as a Ballot winner, that they are able and willing to complete the purchase of the product.
• The price quoted excludes any shipping costs, which must be paid by the Entrant, in addition to the product price.
• The draw will take place within five (5) working days after the ballot closes.
• Winners of the Ballot draw have five (5) days after being notified (by email) that their entry was successful to complete their purchase, whereafter the offer will expire and the entrant will no longer be able to purchase the product.
• No discount coupons apply to Ballot products.
• By entering a Ballot, you agree to receive future communications from NWW, including our newsletters.
• If you do not hear from us we’re really sorry and wish you better luck next time.

Collectors Corner Bottles
Whilst we pride ourselves on usually having pristine / brand new bottlings, The Collectors Corner also contains older bottlings bottled several years or even decades ago. For this reason normal wear and tear, visible aging and even potential dust (a good sign) is to be expected.

Any links on this site may redirect you a third-party website to which we are not affiliated.  NWW may also make use of third-party services.  We do not examine or evaluate this content for accuracy and take no liability or responsibility any third-party products, materials, websites, services or content. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

User Comments, Feedback and Other Submissions
Any submissions done online, by email, post or otherwise containing suggestions, creative ideas, feedback, proposals, plans or other materials (“comments”) may be used by NWW.  You agree that these comments may be used at any time and without restriction or edit in any context and medium and be copied, published distributed, translated and otherwise used and NWW is under no obligation to maintain any confidence, nor to pay you compensation nor respond.  NWW will, at its own discretion, monitor, edit or remove content that is threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions; but have no obligation to do so.

Copyright and Intellectual Property Rights
Unless specifically stated to the contrary, all rights, title, interest and ownership (including those under copyright, patent, trademark and other intellectual property laws) are the sole property of NWW.  You may not access, display, use, download, or otherwise copy or distribute content obtained on this website for marketing or any other purposes without our specific written consent

Limitation of liability
NWW does not give any express or implied warranty or make any other promise regarding the website; including guarantees that it is free from latent defects, errors, malicious software or infringement content.  While every effort will be made to fix any faults as soon as they are identified, the user indemnifies NWW against any claim, demand, loss, damage, cost (including legal) or liability relating to your use of the website.  NWW does not take responsibility for any other websites, regardless of whether the link is available directly from our site or not.

As a customer of NWW, and/or user of NWW website/computer program/software (“the site”) (or websites linked to NWW site), if applicable, you acknowledge that by exchanging information with NWW for purposes of purchasing products from NWW, and/or accessing NWW site, logging onto it or any other websites made available via the NWW site, affiliated with or linked to NWW, (“accessing”), you do so voluntarily and in accordance with these terms and conditions.

• You agree to the terms and conditions contained in this document, and to the extent that you do not agree, you have the right to request access to the records held by NWW in relation to you, and have the personal information deleted.
• You agree to the use of your personal information by NWW and with the acceptance of these terms and conditions, provide your consent as required by any statutory provision.

NWW, its website and these terms and conditions are bound by South African law and any disputes will be governed by the South African courts.  Access to the content and / or the purchasing of goods on the website from countries where such goods are prohibited is illegal.  It is your responsibility to comply with all the applicable laws of South Africa, including purchasing goods from the website from locations outside of South Africa.

RETURNS POLICY
This Return Policy is to be read with the Website General terms and conditions of  Navigate World Whisky (Pty) Ltd (“NWW”):

How to return an item
Please send an email to mailto:ssa@navigateworldwhisky.com, with your order number and name as the reference. Please include your reason(s) for the return and follow below requirements.

If you have not opened or unwrapped the parcel as received and it is still in its original delivery packaging, then no further packing is required.  If you have unpacked the items; it is your responsibility to repacked for return in another box with as much padding and protective packaging as required to ensure it arrives at Navigate World Whisky undamaged.  No refunds will be given if the Items that are damaged when they reach Navigate World Whisky.

Reasons for return

1. Incorrect item delivered
   If you receive an incorrect item, please do not remove the product from its original packaging or any of the stickers or labels; then notify us within 7 days  and we will collect the incorrect goods from you at no charge and will, based on your  choice, either deliver the correct item as soon as possible (provided stock is still available), send you a voucher for the purchase price or issue a refund.
2. Goods arrive damaged
   If goods arrive damaged please contact us within 7 days of receipt of your order.  If the damage is immediately visible, please note this on your waybill / courier delivery form. To assess where in the transit process the damage may have occurred, we require the following information:

    

   1. photograph of the outer box
   2. photograph of the inside of the box, including the inner packaging and
   3. photograph of the damaged item.

   On assessment of above photographs and information provided, if the goods are determined to have been damaged in transit, Navigate World Whisky will, based on your  choice, either deliver a replacement as soon as possible, send you a voucher for the purchase price or issue a refund within 30 days.  Notwithstanding the above, NWW retains the sole discretion to accept a returned item, or reject it, which election shall be made after inspection of the item at hand upon receipt, and subject to compliance with the conditions above.
